Expert Witness & Litigation Support Reporting
Independent before, during and after remediation reporting for solicitors, insurance companies and their clients. We provide comprehensive photographic and written evidence at every stage of disputed contractor works — giving all parties a clear, professional and legally admissible record.
Who is this service for?
When a contractor's remediation works are disputed — whether through negligence, non-compliance with specification, or outright failure — all parties need an independent, qualified expert to document the facts. We work with:
Solicitors & Legal Teams
Instructing us on behalf of claimants or defendants in civil litigation involving defective remediation works. Our reports are prepared in accordance with CPR Part 35 and are suitable for use as expert witness evidence in court proceedings.
Insurance Companies
Where an insurer has assigned a contractor to carry out remediation and the quality of those works is in dispute. We provide independent verification at each stage, enabling stage payments to be released with confidence and protecting the insurer's position.
Property Owners & Clients
Homeowners or commercial property owners who have had remediation works carried out that have failed, been completed to a poor standard, or do not match the agreed specification. We document the failures and the correct remediation on your behalf.
Before, During & After Reporting
Our reporting service covers the full lifecycle of the remediation. Each phase produces a standalone report that can be used independently or combined into a single comprehensive evidential document.
Pre-Remediation Assessment
A comprehensive photographic and written record of all defects, failures and non-compliant works as found. We document every affected area, material and construction detail before any remediation begins — establishing an irrefutable baseline for the dispute.
Stage-by-Stage Verification
Ongoing attendance and reporting at each defined stage of the remediation. We record what was removed, how it was removed, what was exposed beneath, and what was installed at every step — providing a continuous, time-stamped evidential chain.
Completion & Comparison Report
A final written report comparing the original defective works against the completed remediation. Includes photographic before/after comparisons, a schedule of works completed, materials used, and a professional opinion on compliance with applicable standards.
What our reports contain
Every report we produce is thorough, structured and prepared with legal proceedings in mind. We do not produce generic inspection reports — each document is tailored to the specific dispute, the parties involved and the applicable standards.
- Detailed photographic evidence at every stage, captioned and date-stamped
- Written schedule of defects identifying failures against applicable standards
- Side-by-side before/after comparisons for each area of works
- Materials specification and installation methodology records
- Reference to relevant UK legislation, British Standards and industry codes of practice
- Professional opinion on the standard of the original works and the remediation
- Signed CPR Part 35 declaration suitable for use in legal proceedings
CPR Part 35 Compliance
Under the Civil Procedure Rules (CPR) Part 35, expert witnesses in civil proceedings in England and Wales have an overriding duty to the court, not to the instructing party. Our reports are prepared in full compliance with this duty — our opinions are independent, objective and confined to matters within our professional expertise.
Each report includes a signed declaration confirming compliance with CPR Part 35 and the Protocol for the Instruction of Experts to give Evidence in Civil Claims.
Applicable UK law, regulations & best practice
Our reports reference the specific legislation, British Standards and industry codes of practice that apply to the works in dispute. Where a contractor has failed to meet these requirements, we document the failure clearly and cite the relevant standard.
Building Regulations 2010 (England & Wales)
Approved Documents C, F and L set minimum standards for moisture resistance, ventilation and thermal performance. Failures against these are documented and cited in our reports.
BS 8102:2022 — Protection of Below-Ground Structures
The primary British Standard for waterproofing of below-ground structures. Non-compliance with design grades and installation requirements is a common basis for dispute.
BS 6576:2005 — Damp-Proof Courses & Cavity Trays
Governs the installation of chemical damp-proof courses. Failures in drilling pattern, injection pressure and render specification are assessed against this standard.
PCA Code of Practice
The Property Care Association publishes codes of practice for damp proofing, timber treatment and structural waterproofing. We assess works against these industry benchmarks where applicable.
Civil Procedure Rules (CPR) Part 35
Our reports are prepared in accordance with CPR Part 35, which governs the duties and format of expert witness evidence in civil proceedings in England and Wales. Our overriding duty is to the court, not the instructing party.
RICS Guidance — Expert Witness
We follow RICS guidance on the preparation of expert witness reports, ensuring our opinions are independent, objective and confined to matters within our professional expertise.
Vetted contractors & betterment works
Where the scope of remediation extends beyond our own direct remit — or where the client wishes to include additional improvement works as 'betterment' to the schedule — we are able to appoint 3T-vetted contractors from our trusted network to carry out those works.
Betterment items are works that go beyond like-for-like reinstatement — for example, upgrading a dated kitchen or bathroom as part of a wider flood or damp remediation. These items and their associated costs are kept fully separate from the insurance or litigation schedule of works, ensuring complete transparency for all parties.
All vetted contractors are managed directly by 3T Restoration Ltd, with the same reporting and verification standards applied to their works as to our own.
Staged works & insurer verification
Where an insurance company requires independent verification of each completed stage before releasing a stage payment and authorising continuation of the works, we offer a staged works service. At each defined milestone we attend site, verify completion to specification, and issue a stage sign-off report.
This protects the insurer against overpayment, gives the client confidence that works are progressing correctly, and provides a complete audit trail for the file.
- Stage sign-off reports issued at each milestone
- Photographic and written verification of completed works
- Insurer-ready documentation for stage payment release
- Full audit trail from instruction to completion
Scope & Survey Fees
We charge a fixed fee to attend site, carry out the initial scope assessment and produce the preliminary report. This fee is based on property size and is set at the same rates as our standard survey tiers below.
Survey fee refund: If you proceed with remediation works carried out by 3T Restoration Ltd following the scope report, the full survey fee is refunded against the cost of those works. You only pay the survey fee if no works are instructed.
For complex commercial projects, multi-property instructions or disputes involving extensive scope, fees are quoted individually following an initial consultation. Please contact us to discuss your requirements.

We understand that disputed remediation works can involve significant costs and uncertainty over timing. We offer flexible payment structures to suit the needs of all parties.
Deposit & Staged Payments
For larger remediation projects we offer a deposit on instruction followed by stage payments tied to verified completion milestones. Each stage is independently confirmed before the next payment is released — giving insurers and solicitors full cost control and a clear audit trail.

We offer finance packages through our approved finance partner, subject to status and lender assessment. Finance can cover the full cost of remediation works, spreading payments over an agreed term. Our finance partner is authorised and regulated by the Financial Conduct Authority.
